Terms of Use

1. Who we are and what this is about

Active Club is an app by instingo UG (haftungsbeschränkt), Bergstr. 12, 82131 Gauting, Germany ("we"). People in companies, clubs and groups use Active Club to arrange activities together. These terms apply to the apps (iPhone, Apple Watch, Android, Wear OS) and to activeclub.instingo.de. Using them is free.

2. Account

• You must be at least 16 years old.
• You sign in with an email address you have access to and use a name others recognise you by. Don't pretend to be someone else.
• By signing in you agree to these terms. You can delete your account at any time (Profile → Delete account).

3. Communities and clubs

Content belongs to a community (company or group) and its clubs. Whoever starts or manages a community decides who may join and can remove members. A company can tie access to its community to a work email address.

4. Rules of conduct: zero tolerance

Active Club is meant to be a respectful place. The following is forbidden, and we do not tolerate it in any form:

• insults, harassment, bullying, threats and hate speech, for example because of origin, religion, gender, sexual orientation, disability or age;
• pornographic, sexual or violent content;
• content that breaks the law or infringes others' rights (copyright, personality rights), for example photos of people who have not agreed to them;
• spam, advertising unrelated to the community, fraud and malware;
• attempts to disrupt the app, its security or other users.

You are responsible for everything you share.

5. Reporting, blocking and moderation

You can report messages, photos, events, clubs and people in the app and block people. We usually review reports within 24 hours. We remove content that breaks these terms, and anyone who breaks them can be excluded temporarily or permanently, without prior warning for serious violations.

6. Your content

What you share stays yours. You grant us the simple, free right to store your content and show it to the members of the community or club concerned while it is in Active Club. Only share what you are entitled to share.

7. Activities and taking part

We only provide the platform and do not organise events. The people who create an event are responsible for it. You take part at your own responsibility; look after your health and your limits.

8. Availability and changes to the app

We aim for uninterrupted operation but cannot guarantee it, for example during maintenance or outages. We keep developing the app and may change or discontinue features.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are only liable for breaches of essential obligations that make use of the app possible in the first place, limited to the typically foreseeable damage. Otherwise liability is excluded.

10. Ending use

You can stop using Active Club at any time by deleting your account. We can suspend or end use if these terms are broken.

11. Changes to these terms

If we change these terms, we tell you in the app. Significant changes only apply once you agree to them.

12. Final provisions

German law applies. If you are a consumer, mandatory protective provisions of the country you live in remain unaffected. Contact: support@instingo.de.
